What to do if you must electronically file and you have, or are applying for, a fee waiver from the court
If you’re filing court papers in a California court that has made electronic filing compulsory (i.e. they have “mandated” eFiling, such as Orange County or San Diego) and you have a fee waiver, then this information applies to you.
For filers applying for or in possession of a fee waiver from the court, One Legal will also waive the service fees for using our product to file your court documents. This service fee is normally charged in addition to the usual court fees.
There are two ways you can proceed depending on whether or not you have a credit card.
1. Procedure for indigent filers with a credit card
If you have a credit card then you can open a One Legal account and file your court documents using our standard workflow.
Your credit card will not be charged if you include an application for a fee waiver as part of your filing or where you already have a fee waiver on file. If you already have a fee waiver on file you will need to enter details of it in the special instructions box.
Please note that should the court deny your fee waiver application, One Legal is entitled to charge the standard filing service fee in addition to any court fees that apply.
2. Procedure for indigent filers without a credit card
If you do not have access to a credit card then you will not be able to open a One Legal account. Don’t worry, One Legal can still assist you with your filing but you will have to follow a different procedure.
Please complete the form on the right, providing all of the requested information and uploading all of the documents that you need to file. If you already have a fee waiver granted by the court please provide details in the notes section.
